  • Probate litigation refers to legal disputes that arise during the administration of an estate—such as contested wills, trust conflicts, and fiduciary misconduct. Unlike probate administration, which is the routine process of settling an estate, litigation involves formal court proceedings to resolve disagreements.

  • Wills are most often contested due to claims of undue influence, lack of mental capacity, fraud, or improper execution. If you believe a will doesn’t reflect the true intentions of the deceased, a probate litigation attorney can help you challenge it in court.

  • Evidence may include medical records, witness statements, sudden changes to the will, or signs of isolation or manipulation. Courts look for proof that the testator was pressured into making decisions they wouldn’t have made otherwise.

Guardianship Disputes
